Attorney Ken Witzel moderated and served as panelist at EMLF’s 36th annual institute

Attorney Ken Witzel served as the moderator and a panelist on the topic of “Bad Faith Pooling and Unitization in the Development of Shale Formations” at the Energy & Mineral Law Foundation’s Thirty-Sixth Annual Institute on June 30, 2015, in Amelia Island, Florida.  The program addressed difficult situations commonly confronted by oil and gas operators that may trigger bad faith claims by lessors.  Topics addressed included: determining the size and shape of the unit; including a portion of a leasehold in a unit; including non-contiguous acreage in a unit; revising an established unit; and including the same acreage in more than one unit.
