Attorney Ken Witzel presented on the topics, “Negotiating Key Provisions in Pennsylvania Oil and Gas Leases” and “Lease/Ownership Challenges, Disputes and Negotiations” at the National Business Institute’s “Frac Law: From Land Contract Negotiations to Environmental Disputes” Seminar.  As to negotiating oil and gas leases, Mr. Witzel’s presentation gave a general overview of common terms and provisions in many modern oil and gas leases, and discussed certain important provisions, such as pugh clauses, pooling/unitization provisions, and royalty payment provisions in greater detail.  The second part of Mr. Witzel’s presentation focused on lease disputes and emphasized issues such as lease terminations occurring before and after commencement of the secondary term, determining whether production is “in paying quantities,” untimely payment of delay rentals and/or royalties, and termination requirements for flat rate royalty leases.
